We are sharing this recent legal alert that clarifies the “Good Actor” exclusions for sustainable portions of a basin or subbasin. This October 29 decision comes from the appeals court case of Kings County Farm Bureau v. State Water Resources Control Board.

In 2024, the Kings County Farm Bureau (“Farm Bureau”) challenged the conclusion from the State Water Resources Control Board that the entire Tulare Lake Subbasin needed to be placed on probation for failing to show an ability to achieve subbasin sustainability.

The Farm Bureau said they met the standards as a “good actor” for some of the Tulare Lake Subbasin–and the appellate court agreed.
